美国签证被取消，写申诉信再次申请美国签证真实案例分析

客户是劳德珠宝(LORDSPEK),国内一家顶级发掘和收藏有色宝石品牌公司的创始人。客户持B1签证到的美国，通过律师在美国成立了一家有限责任公司LLC。客户在美国参与著名导演吴宇森制作的电影，并担任制片人之一。

客户每次在美国都按期回国，但在2020年时，因为新冠疫情原因，无法回国。所以申请在美国延期。第一次，第二次都顺利通过，但第三次，没有收到移民局通知去打指纹，所以第三次的延期申请被拒绝。之后再次赴美国时，签证被取消。

申诉信的基本思路是展示客人非常优秀，杰出的商业背景。经常与世界各国商业精英合作。强调其在美国和美方商谈合作，在国内融资的紧急性和必要性。

Dear Visa Officer,

My name is XXX. I am founder & CEO of both Beijing XXX Co.;Ltd. and XXX International PVT ltd.The brand that I created is Lordspek. It cooperates with world renowned mining corporation utlizing large mechinary Exploitating mineral resources.

In 2001, Multinationals in China compiled by Economic Daily named Lordspek the most influential colored gemstone in China.

In 2005 - Lordspek, along with the Sri Lankan Embassy in China, hold a charity sale at the Kerry Centre for Tsunami orphans. Ambassadors and the wives of the ambassador's from over 250 countries and regions including the United Nations, the United States, Canada, Italy, Singapore and etc were present at the event. Top celebrity attress and director Jinglei Xu was introduced as Sri Lanka's Tourism Ambassador. This event was an important international exposure for Sri Lanka’s gemstone culture.

In 2007, Lordspek cooperated with the wife of United Nations Representative, Sarah Reid,wife of US ambassador to China, and wifes of ambassadors of more than 30 nations including Sri Lanka,pakistan, Sweden and Morocco Jointly hold jewelry sari show and promote the cultural exchange of jewerlies among different nations.

In 2011, Multinationals in China, compiled by Economic Daily, listed Lordspek again as the "Most Influential Colored Gemstone Brand" of the decade since 2001.

In 2011, Lordspek is invited by the Soong Ching Ling Fund, the former residence of Soong Ching Ling, and Sotheby’s of Hong Kong to host a charity auction, and donated 120 porcelain pieces as well as over ten jewelry pieces to the auction. All proceeds went to supporting the welfare of women and children, and to promote gemstone culture.

From 2012, Lordspek has been committed to promoting ruby and has cooperated with CCTV’s Economic Channel, launching the jewelry collection series "Crazy Ruby," produced by the Economic Information Broadcast. The program created a trend of ruby collection.

In 2018, Lordspek begins to further expand its international market by cooperating with Mr. Bill Shook, a famous American jewelry designer.

In 2019, the Medici Family grant the Knight Medal Title to http://me.In 2021, Lordspek collaborates with with Medici Family, creating the LD· Medici·Jeunys Jewery Brand.

2021 - Prince Lorenzo de Medici signed contracts with Lordspek to carry out in-depth cooperation and jointly established the jewelry brand LD · Medici, using jewelry as the media, so as to continue the Millennium cultural and artistic exchanges between the Medici family and China.

I am mainly responsible for developing the global market and working with world renowned brands in both Europe and the United States. I work closely with the house of Medici in Italy and we act as coopertive partner of Medici.The House of Medici was an Italian banking family and political dynasty that first consolidated power in the Republic of Florence under Cosimo de' Medici, during the first half of the 15th century. The Medicis are one of the most influential and controversial families in the history of the world.The Medicis were instrumental in the rise of the Italian Renaissance and were deeply involved in shaping European Culture and politics for 300 years.

I am aslo partning with Neurosphere Entertainment, a US film development company in developing two movies directed by John Woo, Chinese film director noted for action movies that combine copious stylized violence with lyrical melodramatic depictions of male bonding. The Los Angeles based company, Neurosphere Entertainment finances the development of projects from ideation to scripts, with a thematic focus on heartfelt,inspiring stories related to the US and China.The company’s mission is to build a better understanding between the two countries and encourage learning from each other. I cooperate closely with this company in producing the movies, which is mainly about Sino-US relations. I am mainly responsible for promoting the image of the company and its movie products in China as well as raising captial for developing the movies in China.

I have been to USA for many times and every time I was in the US, I strictly abide by the relevant laws and regulations and leave US on time.My attorney also helped my established a LLC in the US, with the aim to cooperate fully with my US partner. However, in 2020, because of covid-19 pandemic, I was unable to return to China, for there is virtually no flight back to China. In order not to violate the regualtions of the United States, I applied for extensions of my stay for 5 times in total.

In June 2021, I got Biometrics Appointments of my second application(MCT2124595381) and the third application(MCT 2196166383) on the same day. I reset the appointment and finished it, and it went through well. Then I was notified that my first application(MCT 2049462183) and second application(MCT2124595381) got approved in September 2021. however, since then, I have not got approval of my third application(MCT2196166383). therefore I have to keep on waiting and did not move to any other country.

In November 2021, it was time to apply for extention of my stay in US again and I applied for the forth application(MCT 2245057869) on November 25,2021. My third application(MCT2196166383) remained pending until February 2022 when it was denied.The document from USCIS said the reason for the denial is that I failed to attend the Biometrics Appointment. I did not attend the Biometrics Appointment for I did not receive the mailed appointment before the appointment date, so I didn’t know my appointment http://time.In addtion, I had already rescheduled the appointment and finished it well. So my attorney and I resond to USCIS immediately and explained the reason that I was absent at the Biometrics Appointment.

Then I keep on waiting but did not receive any response from the http://Uscis.In April 2022, I planed to go back to China to handle my business,but I was infected with Covid-19 right before the flight.I was seriously ill and even have heart problems, therefore I have to cancel the flight.Meanwhile, I hadn’t received the biometrics appoinment for the forth application, and I didn’t want to violate the rules. Therefore, I applied for my fifth applicaion in May. My last two applications kept pending since then, and the USCIS System has no further prompt.Then the condition of my 91-year-old mother suddenly get worse, and as China begin to widely allow tourists to enter, I went back to China to take care of her in October 2022 and let my attorney follow up my visa matters. After my mother’s situation improved and I also handled my company’s business in China, I went to the US again in order to work with my US Partner to design the movie directed by John Woo. However, when I arrive at the port of entry in the US,the immigration officer informed me that since my third application was rejected, I need to apply for a new US visa in China. So my US visa was cancelled. My last two applications were also denied and so I returned to China.

I applied for the US visa again for I have the urgent need to go to US to negotiate with my US partner, Neurosphere Entertainment, on matters regarding rasing capital in China and promoting the company’s image and its movie products in China. I am a law abiding person and always tried my best to complied with the rules and regulations in the US. I explained clearly in this statement the reason that lead to my failure to attend the Biometrics Appointment that result the rejection of my third application. I hope you may understand my situation and grant my application for the US visa.
